THE DUNLOP MILLION DOLLAR SLAM - OFFICIAL Rules and Regulations (The “Promotion”)


THIS PROMOTION IS BEING CONDUCTED WITH THE INTENT TO SOLICIT THE DEMONSTRATION OF A DUNLOP AEROGEL TENNIS RACQUET. TYPICALLY, A DEMO TAKES ABOUT 2 MINUTES, BUT THERE IS NO MAXIMUM TIME REQUIRED IN ORDER TO RECEIVE A GAME PIECE. NO PURCHASE OF THE RACQUET IS REQUIRED. NO DEMO IS REQUIRED.


This Promotion is intended for viewing and participation only in the 50 United States and Washington D.C. and in Canada, and shall be construed and evaluated according to the laws of the 50 United States and Washington D.C. and Canada. Please do not enter if you are not a natural person who on March 20, 2008 was/is a legal resident of, and not located in, 50 United States, Washington D.C. or Canada at time of entry. VOID WHERE PROHIBITED BY LAW.

1.   PROMOTION PERIOD: Starting March 20, 2008 at 9:00:00 AM Central Time (CT) and ending September 10, 2008 at 11:59:59 PM CT (the "Promotion Period"), or when the supply of unique PINs (see Rule #3 below) is exhausted, whichever occurs first.
2.   ELIGIBILITY:To enter and be eligible to win, you must be a legal resident of the 50 United States, Washington, D.C., or Canada, be 13 years of age or older, and have a valid email address. Persons in any of the following categories are NOT eligible to participate or win prizes: (a) any person who, at any time on or after March 20, 2008, was or is a director, officer, or employee of Dunlop Sports Group Americas (the “Sponsor”), or its  parent, subsidiaries, franchisees, or service agencies; (b) individuals engaged in the development, production or distribution of materials for the Promotion or engaged in the administration or execution of this Promotion (collectively the “Promotion Entities”), and (c) persons who are or purport to be immediate family members (defined as biological or step-mother, father, sister, brother, daughter, son or dependent or spouse of any of the foregoing) of any person in any of the preceding categories, regardless of where they live, or who reside in the same household (i.e., live in the same household for at least 3 of the 12 months preceding the start of the Promotion Period, whether related or not) as any person in any of the preceding categories.
3.   HOW TO ENTER & PLAY: To enter, please visit any participating local pro shop, tennis specialty retailer or participating tennis event (Pacific Life Open in Indian Wells, CA; Sony Ericsson Open in Miami, FL; Family Circle Cup in Charleston, SC; Rogers Cup Canadian Open Masters in Toronto, ON (ATP); Canadian Open Rogers Cup in Montreal, QC (WTA); Cincinnati Masters at Cincinnati, OH) and demo a Dunlop Aerogel tennis racquet. Typically, a demo takes about 2 minutes, but there is no maximum time required in order to receive a game piece. No purchase of the racquet is required. No demo is required. See Rule 11 for how to get a game piece without undertaking a demo. When finished, the participating retail location sales representative or participating event will give you one (1) game piece with a unique PIN per Aerogel racquet demonstrated. Limit one (1) game piece per person per visit.   For purposes of this Promotion, a "visit" shall be deemed to be any visit to a participating retail outlet or participating tennis event within the same day. Sponsor might also give away unique PINs at tennis events in Sponsor’s own discretion. A total of 315,000 unique PINs will be available for distribution during the Promotion Period. (To request a unique PIN without visiting a participating retail outlet see Rule #11 below.) Once you have received your unique PIN, visit www.dunlopsweepstakes.com (the “Web Site”) during the Promotion Period, read and accept these Official Rules and follow the instructions to register. Your unique PIN will then be randomly “assigned” one (1) of the following Dunlop Tennis Players (“Dunlop Tennis Players”): James Blake, Tommy Haas, Tomas Berdych, Tommy Robredo, Nicolás Almagro or Thomas Johansson. The odds of obtaining any particular Spotlight Dunlop Player are 1 in 6. You will be notified on-screen of which Dunlop Tennis Player your PIN has been assigned.  When you return to the Web Site after your initial registration, you will earn one (1) entry into the Sweepstakes draw (see Rule #9 below) each time you enter using a unique PIN. Limit of one (1) registration per regular person/email address; if it is discovered that you have registered or attempted to register more than ONCE, all of your entries will be declared null and void, and any prize you might have been entitled to will not be awarded.
4.   TELL A FRIEND: You may also earn additional Sweepstakes entries by referring friends to the site.  To tell a friend about the Promotion, click on the button on the "Tell a Friend" page to e-mail the message to yourself.  This email message can then be forwarded directly from your email account to as many friends as you want. You will be credited with one (1) additional Sweepstakes entry for each valid and unique email address that is referred, if your friend clicks on the link provided in your email, with a maximum of five (5) additional Sweepstakes entries throughout the Promotion Period. Please note that if your friend types the URL into the address bar of their browser instead of clicking on the link provided, you will not receive additional entries. 
5.   TOURNAMENTS AND CUTOFF DATES FOR ENTRY: The prizes awarded in the Dunlop Million Dollar Slam will be based on the results of the Men's Singles category of the following three Tournaments ("Tournaments"):

Entries received after a Tournament's cutoff date ("Cutoff Date") (see table above) will not be considered for said Tournament, but they will roll over to the next Tournament(s), if applicable. All non-winning entries will roll over from one Tournament to the next, as applicable. Entries submitted after the cutoff date for the U.S. Open (September 6, 2008 at 11:59:59 PM CT) will not participate for the Grand Prize or the Second Chance Prize, but they will be entered into the Random Sweepstakes draw (see Rules #9 and 10.C). Should any Dunlop Tennis Player not participate in any of the Tournaments, or should he get injured and/or retire or be disqualified from any of the Tournaments due to any circumstance, the unique PINs assigned to such Dunlop Tennis Player will not be re-assigned to another Dunlop Tennis Player.

6.   SPOTLIGHT DUNLOP PLAYER SELECTION: On or about the first business day prior to the start of each of the three Tournaments, an independent adjudicator will randomly select the name of one (1) of the Dunlop Tennis Players, who will become the Spotlight Dunlop Player ("Spotlight Dunlop Player") for the Tournament starting nearest the date of the draw.
7.   GRAND PRIZE WINNER DETERMINATION: If the Spotlight Dunlop Player selected for a Tournament wins the Men's Singles category of said Tournament, all of the entrants whose unique PINs were randomly assigned to such player before said Tournament's Cutoff Date will be entered into a random drawing that will take place within fifteen (15) days of the end of the applicable Tournament (exact date and time is the sole discretion of Sponsor) in Winnipeg, Manitoba, Canada. The odds of obtaining any particular Spotlight Dunlop Player are 1 in 6. Whether a Spotlight Dunlop Player wins a tournament is, of course, based upon the skill of the actual player. If your unique PIN was randomly assigned to a Spotlight Dunlop Player who won a selected tournament, the odds of winning depend on the total number of eligible entries received corresponding to such tournament; however, the odds of such an entrant are no worse than in 1 in 52,500. The random draw(s) will take place within fifteen (15) days of the end of the applicable Tournament. The Entrant whose name is randomly drawn will become the Potential Winner of part or all of the Grand Prize (see Rule #10.A). A maximum of three (3) random draws may eventually take place, one after each Tournament as necessary. The Spotlight Dunlop Player must be declared the official winner of the Tournament he was selected for in order for the Grand Prize (or portion thereof) to be awarded. If a Spotlight Dunlop Player wins a Tournament but is subsequently declared ineligible by such Tournament's organizing committee, then the prize (or portion thereof) will not be awarded.
8.   SECOND CHANCE DRAWING: If the Spotlight Dunlop Player selected for a Tournament does NOT win the Men's Singles category of said Tournament, all of the entrants whose unique PINs were randomly assigned to such player before said Tournament's Cutoff Date (if applicable) will be entered into a random drawing that will take place within fifteen (15) days of the end of the applicable Tournament (exact date and time is the sole discretion of Sponsor). The odds of obtaining any particular Spotlight Dunlop Player are 1 in 6. Whether your Spotlight Dunlop Player wins a tournament is, of course, based upon the skill of the actual player. If your unique PIN was randomly assigned to a Spotlight Dunlop Player who did not win a selected tournament, the odds of winning depend on the total number of eligible entries received corresponding to such tournament, however, the odds of such an entrant are no worse than in 1 in 52,500. The random draw(s) will take place within fifteen (15) days of the end of the applicable Tournament. The Entrant whose name is randomly drawn will become the Potential Winner of one (1) of the Second Chance Prizes (see Rule #10.B). A maximum of three (3) random draws will eventually take place, one after each Tournament as necessary.
9.   RANDOM SWEEPSTAKES DRAW: Within fifteen (15) days of the end of the Promotion Period, an independent judging organization (the "Promotion Judges") will randomly draw one (1) entry (the "Potential Winner" of the Sweepstakes Prize (see Rule #10.C)) from among all eligible entries received. The odds of winning depend on the total number of eligible entries received during the entire Promotion Period. The random draw will be held in Winnipeg, Manitoba, Canada. The Potential Winner will be eligible to win the Sweepstakes prize, subject to verification of eligibility under these Official Rules.
10.   PRIZES:
10.A. (1) GRAND PRIZE (if applicable, see Rule #7): $1,000,000.00 USD, payable as a 40-year annuity at $25,000.00 USD per year without interest; present value is approximately $470,000.00 USD/ $462,645.00 Cdn (*) (actual value depends on cost of annuity when prize is awarded). If there is more than one Grand Prize winner, the Grand Prize will be divided in identical fractions accordingly among the winners. Under no circumstance will the Sponsor be liable for more than the current value of the $1,000,000.00 USD at the time of awarding of prize.

10.B. (3) SECOND CHANCE PRIZES (if applicable, see Rule #8): Dunlop Prize Package (two (2) Dunlop Aerogel racquets, one (1) Dunlop Aerogel Racquet Bag, and one (1) case of 24 3-ball cans of Dunlop Grand Prix Tennis Balls) with an approximate retail value of $500.00 USD/$492.00 Cdn.

10.C. (1) SWEEPSTAKES PRIZE: A trip for two (2) to Saddlebrook Resort in Wesley Chapel, FL (Tampa) for a 4 day, 3 night stay and the opportunity to meet Dunlop Tennis Player James Blake. Prize consists of round-trip coach air transportation from a major airport nearest the winner's home within the U.S. or Canada, (airport, carrier and airline ticket class selected at the sole discretion of Sponsor), one (1) double occupancy standard accommodation for three (3) nights (accommodation to be selected at the sole discretion of Sponsor) and $250.00 USD spending money for the winner only. If winner resides within 150 miles of the destination,ground transportation may be substituted for air transportation at Sponsor's sole discretion. All other expenses not specifically mentioned herein, including ground transportation, meals, gratuities, travel documents, tax, personal expenses and all other expenses not specified herein are the sole responsibility of the winner. No responsibility is assumed by Sponsors for canceled, delayed, suspended or rescheduled events after ticketing of prize for any reason whatsoever beyond its control. Transportation and accommodations subject to availability, blackout periods, government restrictions and regulations, hotel, airline, airport or other transportation restrictions and regulations. Other restrictions may apply. Air travel must be booked and taken between November 15, 2008 and December 23, 2008. Winner and guest must have all necessary identification and/or travel documents (e.g. a valid U.S. or Canadian driver's license or passport, as applicable) required for travel. If winner's guest is a minor he/she must be accompanied by parent or legal guardian who must sign and return all required documentation. Guest and winner must sign and return a release of liability/publicity prior to ticketing of prize. Approximate retail value of Sweepstakes Prize ("ARV"): $5,000.00 USD/$4,922.00 Cdn depending on winner's point of departure and airfare fluctuations.

Limit: one (1) prize per person.

Maximum ARV of prizes available to be won: $1,005,000.00 USD/$989,272.00 Cdn.

Prizes are not transferable or redeemable for cash. All prizes must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, who reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. Taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided are the winners' responsibility. Both Canadian and U.S. annuity prize winners will be taxed. All prize details are at the Sponsor's sole discretion.
11.   NO PURCHASE NECESSARY:To obtain a free unique PIN without demoing a Dunlop product, visit a participating retail outlet and request it from the sales representatives. Only one (1) request for a PIN per person per day, while supplies last.
12.   HOW TO CLAIM YOUR PRIZE: In order to be eligible to win a prize, Canadian Potential Winners must first correctly answer, without mechanical aid and assistance, a mathematical skill-testing question. Canadian and US Potential Winners will be contacted by phone, mail or email with instructions on how to claim the prize. Prizes won by persons who are eligible entrants but considered minors in his/her state/province of residence will be awarded to a parent or legal guardian who must sign and return all required documentation outlined herein and otherwise comply with all requirements imposed on Winner set forth herein. If a Potential Winner is found to be ineligible, declines to accept a prize, or Sponsor is unable to contact a Potential Winner within a reasonable period, or in the event that a prize confirmation or prize is returned undeliverable, the prize will be forfeited and, at the Sponsor's sole discretion, prize may be awarded to an alternate Winner. Potential Winners (or parent/custodial parent/legal guardian where applicable) may be required to furnish proof of identification. Before being declared a Winner, Potential Winner (or parent/custodial parent/legal guardian where applicable), may be required to execute return an Affidavit/Declaration of Eligibility/Liability & Publicity Release and a W9 form within ten (10) business days from the time it is postmarked as having been sent by the Sponsor or its representative, or the prize will be forfeited.

Allow 6 to 8 weeks for verification and delivery of your prize after verification. Sponsor and its Promotion Entities shall not be held responsible for any delays in awarding prizes for any reason outside of their control. Prizes will only be delivered to verified Winners.

By accepting a prize, Winners consent to the use of their names, addresses, voices, and statements relating to the Promotion or Sponsor, and photographs or other likenesses, without further compensation, notification or permission in any publicity or advertising carried out by Sponsor or any related entities in any and all media now known or hereinafter developed without territorial or time limitation, except where prohibited by law.
CONDITIONS OF ENTRY:
13.   By entering, entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements and, (ii) agree to be bound by the decisions of the Sponsor and/or Promotion Judges, made in their sole discretion, which shall be final and binding in all matters relating to this Promotion. Entrants who have not complied with these Official Rules are subject to disqualification.
14.   Any PIN obtained through unauthorized or illegitimate sources/channels, including any PIN purchased or obtained online, or at a live auction; or which are not original, are illegible, have been tampered with, mutilated, altered, reproduced, stolen, forged, counterfeited, irregular, marked improperly; or which contain printing or production errors, or any errors in any way, will be void at the discretion of the Sponsor and/or Promotion Judges.
15.  Sponsor is not responsible for late, lost, damaged, stolen, misdirected, mutilated, garbled, illegible or incomplete postage-due submissions of requests. Proof of transmission (screenshots, etc.) and/or mailing does not constitute proof of delivery. All entries/submissions become the property of Sponsor and in no case shall be returned to sender.
16.   The Sponsor reserves the right to disqualify any entrant's registration in the Promotion (and void all associated entries) or entitlement to a prize, if, in the sole discretion of the Sponsor, it determines or suspects that the entrant has attempted to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other fraudulent, deceptive or unfair playing practices (including any entries generated by script, macro, robotic, programmed, or any other automated means).
17.  If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
18.  As a condition of entering, entrants (or their parent or legal guardian if an eligible minor) agree: (a) to release Sponsor and Promotion Entities, and each of their officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to participating in the Promotion or the awarding, receipt, possession, and/or use or misuse of any prize or any travel related thereto, (b) that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs.
PROMOTION OPERATION:
19.  Sponsor reserves the right in its sole discretion to cancel, modify or suspend this Promotion at any time, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes corrupt the administration, security, integrity or proper play of the Promotion.
20.   Sponsor and the Promotion Entities do not warrant that access to the Promotion will be uninterrupted. Sponsor and the Promotion Entities are not responsible for any problems that may arise, including but not limited to; (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, Web sites, or other connection, availability or accessibility problems arising in connection with or over the course of the Promotion; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of any prize or in any prize notification documents; or (d) for any other errors of any kind relating to or in connection with the Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion; or (f) damage to a user's system occasioned by participation in this Promotion or downloading any information necessary to participate in this Promotion.
DISCLOSURES:
21.  Any attempt by an entrant or other individual, to deliberately damage any website or undermine the legitimate operation of this Promotion, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Entrant engaging in any of the foregoing activities may be disqualified and will forfeit any prize(s) won.
22.  In the event of any discrepancies between the English language rules and the non-English language rules, the English rules shall prevail.
23.   In the event of any conflict with any Promotion details contained in these Official Rules and Promotion details contained in Promotion Materials (including but not limited to point of sale, television, and print advertising, promotional packaging, and other promotion media), the details of the Promotion as set forth in these Official Rules shall prevail.
24.  Residents of Quebec: Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
25.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of South Carolina without regard to South Carolina conflicts of law principles. All entrants consent to the exclusive jurisdiction and venue of the state or federal courts sitting in the State of South Carolina.
26.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In particular, Sponsor's employees are not authorized to waive, modify or amend any provision or provisions of these Official Rules in any manner whatsoever.
27.  This Promotion is solely sponsored by Dunlop Sports Group Americas Inc., 25 Draper Street, Greenville, South Carolina, 29611.
28.  For a list of the major prize Winners, send a self-addressed postage stamped envelope to: "The Dunlop Million Dollar Slam - Winners list request", 25 Draper Street, Greenville, South Carolina, 29611, to be received by September 10, 2008. Canadian residents may omit return postage. Winners list will be sent after all prizes have been awarded.
29.  To review our privacy policy, please visit our web site at www.dunlopsport.com to see how we use personal information obtained in connection with this Promotion. Personal information collected from entrants will be used by the Sponsors for the purpose of administering this Promotion. Personal information may be collected, used or disclosed in jurisdictions other than Canada. Personal information that resides in jurisdictions other than Canada will be subject to the general laws of application in those jurisdictions. Sponsors will not sell, share or otherwise disclose personal information of entrants with third parties or agents, other than to third parties or agents engaged by Sponsors to fulfill the above purposes or as permitted or required by the applicable laws.
